Implied Status

If a foreign worker, a visitor, and or a student have applied to extend their status as a temporary resident before their status expires, they can legally stay in Canada until a decision is made on their application. This duration of time is called Implied Status. Term Implied status has a new name called Maintained Status.

Restoration 

If your current status expired and you have not applied 30 days prior your status expires you must apply to “restore your status” with in 90 days when your status expires.

If it has been more than 90 days then you must leave Canada immediately and re-apply from outside Canada.

Visitor Record 

When you entered Canada you would have entered on either of the following documents:

  • A visitor visa (also called temporary resident visa) or
  • An eTA (electronic travel authorization).

You would have to make sure that either of your documents are valid during your stay. If you would like to stay Canada longer and would like to extend your stay, you would have to apply for a Visitor Record. A Visitor record is not a visa, it is a legal document that gives you a status and allow you to remain in Canada legally.

Extend your status

You can extend your stay as a visitor, a foreign worker or as a student any apply to extend your status by:

  • Submitting an application before the expiration of the current status.
  • Continuing to meet all the requirements of your stay.
  • Meeting all the necessary requirements of the current process you are applying under.
  • You must be admissible to Canada at the time the application is in process.

Bridging open work permit (BOWP)

If you are a Foreign National working in Canada and would like to extend your work permit then you might be eligible for Bridging open work permit while your application for permanent residence is in process. You can extend your stay as a temporary worker as long as:

  • You are currently in Canada.
  • Yave valid status on a work permit that expires in 4 months and,
  • Have received a confirmation from IRCC that your application for permanent resident is under process.

BOWP extension only applies if your application of permanent residence is under process under following streams:

  1. Federal Skilled Workers (FSW).
  2. Federal Skilled Trades (FST).
  3. Canadian Experience Class (CEC).
  4. Provincial Nominee Program (PNP).
  5. Live-in Care givers under Child or Home Support Programs.
